By accessing or placing an order through pellavio.com ("the Site"), you agree to be bound by these Terms of Service. Please read them carefully before using the Site. If you do not agree with any part of these terms, please do not use the Site.

These terms apply to all visitors, customers, and others who access or use the Site. Pellavio reserves the right to update or change these terms at any time without prior notice. Continued use of the Site after any changes constitutes acceptance of the revised terms.

You agree to use this Site for lawful purposes only and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Site. Prohibited conduct includes, but is not limited to:

— Using the Site to transmit any unlawful, defamatory, fraudulent, or otherwise objectionable material.
— Attempting to gain unauthorised access to any part of the Site or its related systems.
— Reproducing, duplicating, copying, or exploiting any portion of the Site without our express written permission.

We reserve the right to terminate access to the Site for any user who breaches these conditions.

Product Descriptions

We make every effort to display our products as accurately as possible, including colour, texture, and dimensions. However, we cannot guarantee that your screen's display accurately reflects the true appearance of the product. All measurements are approximate.

Order Acceptance

Placing an order on the Site constitutes an offer to purchase. All orders are subject to availability and acceptance by Pellavio. We reserve the right to refuse or cancel any order at our discretion — including in the event of pricing errors, suspected fraud, or stock unavailability. You will be notified promptly and any charges will be refunded in full.

Availability

Product availability is not guaranteed. In the event that an item becomes unavailable after your order is placed, we will contact you to arrange an alternative or issue a full refund. We are not liable for any loss or inconvenience caused by stock availability changes.

Custom & Made-to-Order Items

Where a product is listed as custom or made-to-order, cancellations and changes cannot be accepted once production has commenced. Please review your order details carefully before confirming.

Prices

All prices displayed on the Site are in Australian Dollars (AUD) unless otherwise stated. Prices are subject to change without notice. The price charged will be the price displayed at the time you complete your order.

Taxes & Duties

Prices displayed do not include customs duties, import taxes, or other charges that may be levied by your country's customs authority. These costs are the sole responsibility of the customer. We recommend checking your local import regulations prior to placing an order.

Payment Methods

We accept all major credit and debit cards, as well as payment methods available at checkout. All transactions are processed securely through Shopify Payments or our designated payment provider. Pellavio does not store your payment card details.

Pricing Errors

In the event of a pricing error, Pellavio reserves the right to cancel the order and issue a full refund, or contact you with the correct price before proceeding. We are not obligated to fulfil an order placed at an incorrect price.

All content on this Site — including but not limited to text, photography, product images, logos, brand marks, design elements, and copy — is the exclusive property of Pellavio and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, republish, distribute, transmit, display, modify, or create derivative works from any content on this Site without prior written consent from Pellavio. Personal, non-commercial use for reference purposes is permitted provided you do not alter the materials and you retain all copyright notices.

To the fullest extent permitted by applicable law, Pellavio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — this Site or any products purchased through it.

Pellavio's total liability to you for any claim arising from or related to these Terms or your purchase shall not exceed the total amount paid by you for the relevant order.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to suspend, withdraw, or modify the Site at any time without notice.

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using the Site, you consent to the collection and use of your information as described therein.

We take the privacy and security of your personal data seriously and handle it in accordance with applicable data protection laws, including the Australian Privacy Act 1988 and, where applicable, the EU General Data Protection Regulation (GDPR).

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
